Jack Smith is trying to rob Trump of an immunity defense, and make sure all trials are in progress before the General Election (in the hope of max election interference), but in a Supreme Court composed of six Republican appointees (three of which were appointed by Trump), there is great danger for Smith, if SCOTUS rules against him, all of Trump’s indictments will collapse, and that will only add fuel to a Trump reelection campaign that is already a juggernaut. The Supreme Court decided on Wednesday to take up a case that could have implications for special counsel Jack Smith’s 2020 election case against former President Donald Trump.
The case involves a question about the scope of the “obstruction of an official proceeding” charge that has been brought against hundreds of Jan. 6 defendants.
The statute is connected to two of the four charges against Trump.
The Supreme Court accepted a case Wednesday that could further complicate special counsel Jack Smith’s timeline for bringing former President Donald Trump to trial in Washington, D.C., on charges stemming from his alleged efforts to overturn the 2020 election.
The justices agreed Wednesday to take up a case challenging the scope of an obstruction law that has been used to charge hundreds of Jan. 6 defendants — along with the former president. The statute, Section 1512(c)(2), is connected to two of the four counts Smith levied against Trump in his indictment.
With two key charges in question, Trump’s March 4 trial date appears increasingly unlikely, despite Smith making every effort to maintain it.
“The decision by SCOTUS today to take up the appeal on the 1512 ‘obstruction of an official proceeding’ case means the Trump DC case will not be going to trial,” lawyer and former federal prosecutor Bill Shipley wrote on Twitter. “This is the easy way to make that happen without directly acting on the Trump case on an expedited basis.”

During Sunday's episode of MSNBC'sVelshi, host Ali Velshi spoke with former U.S. attorney and analyst Barbara McQuade about whether hundreds of other January 6 defendants' charges will impact Donald Trump's consequences.
"Donald Trump has also been charged with obstruction of an official proceeding in Jack Smith's election interference case — the same charge that some 300 other people have faced," Velshi said, asking McQuade, "Given that the Supreme Court is considering this, among other things that the Supreme Court's dealing with — the Jack Smith petition. Is there overlap? Does it matter? Will the Supreme Court's decision on the other January 6 defendants — the 300 of them — have an impact on the Jack Smith case against Donald Trump?"
The former US attorney replied, "I think it could. As you say, two of the four counts involve this particular statute. And I'm actually a little worried about the outcome on this one. The immunity, not at all. This one I am. The fact that the court took it up suggests that it should take on a very narrow reading of the statute, which is amid the Roberts court has done, again and again in the kind of statutes that are used in corruption cases. So Jack Smith has to really think about what he wants to do here. He could dismiss those two counts, and focus on the other two — conspiracy to defraud the United States, and violation of voting rights — that would be a safe way to go."
